Real Estate
Subject Description
This course provides the student with a broad foundation of legal concepts and applications relevant to the legal practice area of residential real estate. All aspects of the basic residential real estate transaction are covered including land division in Ontario, the many faceted land registration system, surveys, title insurance, ownership, the agreement of purchase and sale, the numerous applicable statutes, purchasing, selling, financing, closing the transaction, etc. A good command of the written English language is a definite asset.
Credit Status
This is a credit course applicable towards the Institute of Law Clerks Certificate Program, which prepares you to write the Institute of Law Clerks provincial Real Estate examination. Upon successful completion of the ILCO examination, the Institute forwards a certificate along with the Real Estate seal. There are places for four seals to be affixed to the certificate, representing each of the four examinations. This certificate indicates that you have successfully completed the educational requirements of the Institute of Law Clerks Associate level program.
Learning Outcomes
Upon successful completion of this subject the student will be able to:
1. Apply knowledge of real property law through legal research techniques, legal reasoning and critical and analytical thinking;
2. Use descriptions, plans, surveys, the Planning Act and relevant statutes appropriately;
3. Execute title and additional searches;
4. Construct letters of requisitions, agreements of purchase and sale and mortgage transaction documents under the supervision of a lawyer;
5. Determine any relevant Crown patents, road allowances, water rights, liens, encumbrances, easements, restrictive covenants and required financing in a real estate transaction;
6. Explain the status of the owner and the role of the title searcher;
7. Process sales transactions, agreements of purchase and sales and condominiums' and co-operatives' land residential leases;

Camera Use and Recordings - Synchronous (Live) Classes
Synchronous (live) classes may be delivered in person, in a Flexible Learning space, or online through a Seneca web conferencing platform such as MS Teams or Zoom. Flexible Learning spaces are equipped with cameras, microphones, monitors and speakers that capture and stream instructor and student interactions, providing an in-person experience for students choosing to study online.
Students joining a live class online may be required to have a working camera in order to participate, or for certain activities (e.g. group work, assessments), and high-speed broadband access (e.g. Cable, DSL) is highly recommended. In the event students encounter circumstances that impact their ability to join the platform with their camera on, they should reach out to the professor to discuss. Live classes may be recorded and made available to students to support access to course content and promote student learning and success.

Modes of Evaluation
ILCO Examination only. No in-course evaluation; no final grades
Participation in the assignments and discussion is deemed essential in order to be properly prepared for the ILCO provincial exam.
Academic Honesty
Students at Seneca College are expected to be honest and forthright in their academic endeavours. When students cheat on an examination, steal the words or ideas of another, or falsify their research results, it corrupts the learning process. A Seneca College degree, diploma or certificate signifies to society mastery of a set of defined learning outcomes in a designated field of study. If academic credit is obtained dishonestly, the value of every graduate's diploma in the field of study is diminished, as is the reputation of the college as a whole.
Penalties for Academic Dishonesty
The penalty for a first offence is a grade of '0' on the assignment or examination. The penalty for the second offence is expulsion for a time period determined by the Academic Honesty Committee, normally for a minimum of three terms.
